For singer and music producer Sona Mohapatra and her husband, music-composer Ram Samapath, it was not an easy task to find work after they got into a legal battle with filmmaker Rakesh Roshan and music-composer Rajesh Roshan over a copyright issue in 2008.

Sona and Ram, who run a music company, had accused the Roshans of copying the music for the four tracks in their film, Krazzy 4, from Sampath's composition The Thump. The Bombay High Court had declared the Roshans guilty. However, Sona says that the couple had a tough time getting work after clashing with big names.

"We were out of work for a year after that case. We run a fairly big set up as a production house and it was tough for us because we had so many salaries to pay. Yet there were people like Aamir Khan, who said that it doesn't matter. He was working with us even after we sued the Roshans, says Sona, who recently performed in Moscow to celebrate 70 years of Indo-Russian friendship and diplomatic ties.


The singer, who is known for independent numbers such as Abhi Nahi Aana and Rangbati believes that after the case, things changed in the music industry to a large extent. "We were the first ones to fight for copyright issue and it became a landmark case and affected the way people think people used to blatantly copy and think that everything is possible in India. This case put fear in people's minds about the repercussions, adds Sona.

Recently, the singer has been at loggerheads with other Bollywood celebrities such as Sonakshi Sinha recently and she admits that it can cause harm to her career. "I am very well aware of the fact that I'm jeopardising my work, as well as my partner's work, and that is sad. However, there are people who will back you in such times, concludes Sona.

So the Roshan's were found guilty? What was the penalty for that?

MUMBAI: It was a "crazy" day in court on Thursday. The Roshans --- Rakesh and brother Rajesh --- were censured for dishonesty but they ensured the Friday release of their latest film Krazzy4.

The Bombay high court initially restrained producer Rakesh Roshan from releasing Krazzy4 without first deleting its plagiarized music score, but eventually allowed a settlement between the Roshans and music composer Ram Sampath, who had dragged them to court for copyright violations.



Hrithik Roshan's SMSes in his father's defence failed to work and only a settlement of Rs 2 crore saved the day for the Roshans, with the young composer coming out of the controversy feeling "vindicated".

A cheque of Rs 1,77,34,600 (the amount after tax deductions) was handed over to Sampath in the post-lunch session by the Roshans. Sampath had originally demanded Rs 2 crore in the suit and refused to negotiate.

"We are eager to encash the cheque and they (the Roshans) are eager to release the film," Virendra Tulzapurkar, counsel for Sampath, said before the consent terms were approved by the court which vacated its order of injunction.


In a landmark order for the entertainment industry, justice D G Karnik in the morning held that Rakesh and Rajesh Roshan were prima facie guilty of copyright violations and plagiarism.

Bombay HC said: "(Music composer) Ram Sampath has proved that he is the owner of copyright and that the four tracks in Krazzy4 are a copy of The Thump (the music he created for a television commercial for Sony Ericsson)... None of the Roshan's defence arguments has any merit."

Hrithik, who had a part in the video for the commercial with Sampath's musical score, had - after sending two SMSes urging Sampath not to "stress out" his father Rakesh Roshan "at his age" - sent a long explanatory message on April 4. The text message, along with the clinching expert opinion by composer Shiv Mathur and the fact that Roshan had indirectly admitted to using six seconds of The Thump in the film's score, helped the judge rule against the Roshans.

Hrithik's message to Sampath read: "Ram, I just wanted you to know that I am a flag-bearer in the fight against piracy, which is why we didn't move forward till we acquired an NOC from Ericsson." Hrithik said the norm in the Indian film industry was that the producers held the copyright and so there was "no reason to doubt the NOC".

The court said that the SMS was sent by Hritik on his father's behalf and clearly mentioned that they had used Sampath's music after the NOC. "But in his affidavit, Rajesh Roshan (Hrithik's uncle) says he composed the music himself. The two versions are at variance. It appears the Roshans thought they would take the defence that they had the permission to use Sampath's work but changed their stand and denied infringement when they found that Sony Ericsson was not the owner of the copyright."

"This dishonesty is the other reason which disentitles the Roshans from claiming that they were in the right," the verdict said. The judge, who heard both Sampath's music and the film's tracks, said: "To my untrained ear, the music (in the two works) appeared to be similar." Rakesh Roshan claimed that he had sought permission from Sony Ericsson to use some portion of the said music in the film and was granted permission by the letter dated December 13, 2007.

"All these days, Sampat chose to wait. This was a well planned scheme to harass me. Finding myself caught in a helpless situation, I succumbed to the pressure and had to compromise in order to get the film released on the scheduled date," Roshan added.

Chargesheet filed against Rakesh Roshan for plagiarism

The Uttarakhand police have filed a chargesheet against noted Bollywood filmmaker Rakesh Roshan, reportedly accusing him of plagiarising portions of a story written by a city-based man and using it in his 2013 blockbuster 'Krrish 3'.

The chargesheet was filed yesterday in the court of Chief Judicial Magistrate Vivek Diwedi by sub-inspector Subodh Kumarposted at Dalanwala police station, Sunil Kumar who is the lawyer for the author said.


According to an FIR filed at Dalanwala police station here in May last year, Roshan, who is the producer and the director of the movie, had reportedly plagiarised portions of local writerRoopnanarayn Sonkar's novel 'Sooardan' in his 2013 blockbuster.


The chargesheet claimed that enough evidence has been found against Roshan for violation of Section 63 of the Copyright Act and urged the court to send summons to Roshan and take appropriate action against him if he does not respond.
