The scene you described is not a rape. The rape is yet to come.
This is a definition of rape from a health care site:

So you see, it really is of no consequence whether he is her husband or her lover - if he forcefully sexually assaults Mets, against her will, then it is rape. Marriage is not a defence. In English law, marriage stopped being a defence after the precedent set by R v R 1990.
Russell - force is force, whether or not you love that person. If the man says "Yes" and the woman says "No", and he forces himself on he, it doesn't matter how much he "loves" her (I admit, I can't imagine how that could be justified as love) or is "frustrated" with her - she has still refused, and thus it is a crime.
Rape within marriage is an accepted crime, whether or not you personally believe it.
And as for your scenarios, well picture this:
Man marries girl who loves him very much, but on their wedding night goes off and sleeps with his ex. Then he brings said ex into the house and tells everyone that she will live with him, as his wife/gf/whatever. He tells his legit wife that he was forced to marry her and there is no relationship there. He insults her at every given opp, supports his gf over her, and then suddenly starts to get jealous because his wife has a friend who supports her. The minute he discovers that his gf has been lying to him, he kicks her out, not realising the irony that he too has hurt and insulted his wife and whole family. All of a sudden, months later, he crudely tells his wife that she can "come back to their bedroom", not knowing or caring whether she wants to forgive him or not. Then, acc. to the promo, he (presumably) finds out that his wife has a lover/friend, and suddenly the 'man' in him awakens in typical "If she's not mine, she's no one's" style. Then he rapes her, because he is her husband and she is not allowed to have friends, or to fall in love.
Seem fair to you? He's been mentally abusing her for months, now he's just about to do it physically.
