i think that kumkum and crew taped the conversation of Tiple and Nivi.

Quite possible.. Though I'm yet inclined to believe that Tiple has joined hands with KK and its all a joint plan.

Katara's hands not tied, and having a gun with him.. makes me believe that it was all a planned move and just to make Nivi believe that she killed Katara and hence cannot be brought to court

yup i think she cud have done that or maybe she bribed Tiple and got him on her side or maybe she even tricked Tiple aswell
I wonder how she found Katara though

She must have either gave Tiple money or told him that if he supports Nivi he cud go to prison with her and loose his job
