hello frnds...i saw many of u hv lots of doubts about court proceedings...
so here i try to clear ur doubts
1st of all what u hv seen on tv or cinemas its far away from real court proceedings...
in hd mandira was victim and who represented victim is called prosecutor ( who actually filed d case)
nd sameer is accused ...who represented accused is called defendant...
prosecutor always start pleading first wid opening statements
but here we saw different things ...here defence lawyer start pleading first...😉
nd rani ji does d work of prosecutor(victim's lawyer)...😆nd rishi play lyk defence (accused) lawyer😆
there are mainly 6 steps...:
1. Framing of Charge
2. Recording of Evidence
3. Recording of Statement of Accused
4. Defence Evidence
5. Arguments of Prosecution & defence
6. Judgment
bt 1st of all yahan pe framing of charge nehi hua...
After framing of charges the judge proceeds to take the 'plea of guilt' which is an opportunity to the accused to acknowledge that he pleads guilty and does not wish to contest the case.
After plea of guilt is taken, if accused pleads 'not guilty' or court does not accept his plea of guilt, trial moves on - prosecutor then explains to the court the basic outline of the case and what evidence he proposes to lead in order to prove the same..
as per as d drama relating to d photographs (which was shown in d last episode) is concern... its never happen in d court room ...1st of all if any lawyer wanna use d photos as evidence...judge would send them to forensic lab to prove whether its real or fake...after dat its completely upto d judge whether he/she take them as evidence ...considering how much its relevant to d particular case...
