@Bold: Your argument is based articles that may have been planted by the PR. So I wouldn't really take it as gospel truth. The officers who said that she wouldn't let the cops examine her devices were not even named. And any source can be made up.

My argument, however, is based on what Kangana said and she said she gave whatever the cops asked for. Of course, not saying she cannot be wrong. But at least it is based on the actual person rather than some PR planted article. Had Hrithik actually said these things, I would give it more weight. Until then, nope. I'm not going to believe the PR planted articles' version.

And the thousands of mails that were sent to Hrithik - why did he wait for almost a year to make a file of those mails and report to the police?

We use terms like illegal immigrant - that doesn't mean that immigrant is a criminal. The nature of offence isn't so grave - this is in laymen's terms.

Here's a better definition:

Illegal activity is activity that contravenes the law.

Criminal activity is illegal activity that is also a crime. What constitutes a crime is usually detailed in a criminal code in each jurisdiction but can derive from common law crimes like murder, arson, rape etc. A crime is an offense against society and is generally prosecuted by the state.

For example (may vary by jurisdiction):

  • Breaking a contract - illegal
  • Stopping in a No Stopping zone - illegal
  • Negligently polluting the environment - illegal
  • Breaking someone's arm - crime
  • Deliberately ramming someone with your car - crime
  • Recklessly polluting the environment - crime

You have said it was PR before and I have answered before but here it is again. In the Rajeev Masand interview Kangana confirmed she did not give up her "gadgets" that the police asked for.

As for the delay, he clearly underestimated what she was capable of and hoped she would move on - as apparently he still does even after all of this. On top of that he didn't bother to read most of her mail. Has it occurred to you that since he flagged her as spam (as Kangu supporters constantly say he should have) and most emails were unopened he didn't immediately realize the extent of her verbal threats? Which would also explain why he began with a general practice lawyer and then switched to a criminal attorney.

To answer about what crime she is accused of: harassment. I don't know the ins and outs of Indian penal code but I would think sending harassing emails in which you make threatening statements like I will scar you would be as illegal in India as it is in America.

She says about Hrithik's complaint: which reads "Take my laptop, take her laptop" - To this, she is saying "Why would I give my gadgets?", which is justified because she has her personal stuff on it, who is Hrithik to say "take her stuff"? BUT. After when cops came to her house, she says "how can I refuse cops?". Nowhere did she say cops asked for gadgets and she refused.

In fact, the Roshans with their clout could not get a cop to give a quote on what actually happened with her case? If indeed she refused, we would have an on the record quote of a cop saying she refused. But we don't. All we have is sources.

Really? More than a thousand mails and he couldn't pick up his phone and tell Kangana that she is talking with an imposter? (Which he would in normal circumstances: they have worked on two films together ). Or block her contact? (the easiest way out?).

Oh he tagged them as spam? AFAIK, mails tagged as spam get auto-deleted in 30 days. So how did they last more than a year?

This is a very general definition I suppose. And also laws differ from country to country. In India such cases falls under some IT act I think and cases under this law can fall under both civil and criminal jurisdiction.

Of course it's a general definition because Nova asked out of curiosity and I answered from whatever I know.

But I'm asking again, please tell me which law it is which states it is a crime to spam.

I am really interested to know if it exists because I am incessantly spammed by a few websites, and I would readily slap criminal cases against them. šŸ˜†
