I don't know where you stay but here in India population is a major problem because of which there is poverty. IMO Govt has every right to advice people to have 1 or 2 kids to control population and this is not done by Modi or BJP but has been addressed since decades by the govt urging people to have 1 or 2 kids and help in controlling population. So to answer you, Govt has every right to control the population.
If these rich people already have kids and also have so much money, they why can't they simply donate it to orphanages who looks after 1000kids instead.
You will now say it is their wish but there is something called as moral and social responsibility as well.

If everybody has 3, 4, 5 kids I can imagine what the situation would be tomorrow in India. We as citizens should do our part and not simply have kids because we can afford.

People mostly commenting here do not stay in India and seems have no idea about population explosion here.

If something is banned and still going on it is illegal right??

Some of here are from Pak and from Google I got to know surrogacy is ILLEGAL in Pakistan.
So my Paki friends did you do a similar backlash in your country as well or is it only when India makes a law people raise issues???

Yes... the medical association in Pakistan has been trying very hard to make surrogacy legal.. There is nothing wrong with surrogacy.. Its actually a way to save marriages too... While I agree that commercial surrogacy is a tricky road, banning ppl who already have kids from surrogacy is wrong.. If a country wants to control population, it shoukd restrict the number of children that all families have... How does it matter to them if the child is born naturally or via surrogacy? And that goes for both the countries.. Unfortunately Pakistan does not alliw surrogacy but India does which is commendable but this law does not make amy sense to be in a neutral unbiased way... Not bashing the country, simply commenting on a law

India is well on its way to become the most populated country in the world! A dubious honor it could have very well done without.

In a way its a restriction for misuse but other way it will stop people from having kids who want kids by these means. So it shouldn't be banned instead rules should be made for not its misuse.
