Though several laws have been passed with the progress of time, the divorce procedure in India is still complex and you will have to contest the divorce for several months. The Indian judicial law believes that the extended time span might workout well for the couple to reconsider their marriage and hence, a marriage will be saved from being dissolved forever.

A Brief Outline of the Procedure of Mutual Divorce in India

Mutual Divorce is to be filed by the couple only after they have lived apart for at least a year. A petition supported with affidavits for divorce should be filed in the district court by the both the spouses. The husband and the wife should jointly state to the court that they are unable to live together as they are facing immense difficulties in adjustment.

The filing of divorce petition by both the husband and the wife is legally known as the "The First Motion Petition for Mutual Consent Divorce". "The Second Motion Petition for Mutual Consent Divorce" mentioned in the sub-section (2) of Section 13 B is filed when the couple reappears to the court for the second time after a period of six months. If the judge is satisfied after a hearing from both the husband and wife, the court announces a mutual divorce decree.

If the couple fails to appear in the court after six months and not later than eighteen months from the date of first motion, the divorce petition becomes null and void. Either of the couple can withdraw his/her petition within the six months term.

A judgment for mutual divorce is passed out only if all the necessary agreements required for a mutual divorce in India are strictly maintained. The husband and the wife should come to terms of settlement regarding the following issues.

  • Custody of Child
  • Return of Dowry Articles / Istridhan of Wife
  • Lump Sum Maintenance Amount of Wife
  • Litigation Expenses

So this means,
that Divorce will become null if he does not appear.
I am confused. I mean Gauri wants this divorce to happen right then why is she making jagya create a hurdle in the process.?

Does she not know that Jagya wants to be married to Anandi and she is risking her only chance of getting proper divorce?

I am not sure where the Cvs are heading with this

Does Gauri want divorce or not?

Gauri wants divorce. But she is now making this the trump card. She knows that divorce their need is the need of the family. So she is playing with the emotions of the family. It is like Jagya will get divorce and they could enjoy the Singh's property by blackmailing them.

I wish G's plans backfires. They don't get divorce and they don't get money and they live with the fear of being jailed anytime.
So either G accepts the divorce peacefully or lives with this insecurity.

Gauri wants divorce, but she is calculating that the Singh's need for the divorce is equally high.

Till now Jagya-Anandi were on talking terms so she feared Jagya would go back to Anandi, so she was paranoid abt their relationship. Now she is successful in poisoning his mind against Anandi & also against the family...and now they also won't want him back. So according to her, its a point of no return...Jagya has no option but to stay with her. So her insecurity has reduced & she is taking this calculated risk.

But I think she has either forgotten or is underestimating the fact that one visit from Anandi to the police can land up Jagya in jail & can break their bhara pura sansaar...OR maybe the CVs have forgotten this!

How about Divorce which is NOT by mutual consent ? If Anandi files a case against Jagat for bigamy then will the divorce proceedings be diff?

Also she is forever suspicious of Anandi! See how she percieves this situation that Anandi is going to benefit from the divorce and she is going to take away from Jagiya his right! Stupid short-sighted people can think only like this!

Anandi can still get a divorce on the grounds of " Irretrievable break-down of marriage" since the separation period is a minimum of continuous 3 years,& Jagya can not challenge it...
moreover he shd face adultery , bigamy,deception...etc.,
So no worries @ all...

I think the bigamy case will be the Singh's last resort. Gauri and Jagya are too confident that they will give into their demand as they wouldn't want to drag their name through the mud if they have Jagat up for bigamy and have him sent to jail. Hopefully Dadisa instructs Bhairon and Anandi to do it and disown Jagat for good.

Gauri wants jagat divorced from anandi but she wants😉 alimony for jaggu ..😉free cash ke saath jaggu free ho toh inki life aaram se katt jayegi..
seriously though ,i think she had given up on her divorce dream seeing his attitude but now the singhs themselves are offering divorce ,so with papers signed gauri thinks no chance of him returning to anandi ..so why not stake claim before cutting all ties with singhs ..
