He just decided to unilaterally take the decision that she is better off without him.

Shiva did not swear for not getting married to Disha.. he swore that he did tell Disha that he is not interested…to which Dhara replied to tell her more clearly… for which he said that Its their fight .. let them fight for their relationship…

so in a way even if in future he decides to go ahead with the wedding… he is not technically breaking any oath…
