Seems like she has struck a deal with Vivek for that video. Matlab in swara case he may be released.

Saving the kid from charges is more important than custody.

And custody there is no issue as of now because malhar is the only one eligible for it and he will willingly give moksh to Kalyani. Sarthak really cannot do anything there.
