Bandra hit-and-run case paper missing, claims Salman Khan's lawyer
In a hearing in the appeal filed by actor Salman Khan, challenging his conviction in the 2002 hit-and-run case, Khan's counsel on Tuesday informed the Bombay High Court that the registry had not provided him with the complete record of evidence and other documents presented before the trial court.
Counsel Amit Desai moved an application before the HC, claiming that the paper-book, which is a compilation of evidence and documents, prepared by the court registry and submitted to both sides before the appeal is heard, had some documents missing.
The plea claimed that document pertaining to the media interview given by Ravindra Patil, a policeman who was Salman's bodyguard then and a witness to the accident, was missing.
Patil, who died during the trial, had contradicted himself on the statement given before a magistrate in this interview. Patil had stated before the magistrate that Salman was driving the car at the time of the accident and was under the influence of alcohol.
Prosecutors Purnima Kantharia and SS Shinde pointed out that though the paper-book may not have this document, it had been placed in the "records and proceedings", and hence was available for the defence lawyer.
However, Desai maintained that the paper-book should be prepared according to HC rules, which was not done.
The court has now adjourned the hearing on the appeal to Wednesday.
