Sunjay Kapur's wife Priya Kapur fights back regarding Delhi HC’s lack of authority in foreign assets

The legal battle over Sunjay Kapur's estate continues, with Priya Sachdev Kapur, his widow, at the center of the dispute. The conflict arose when his children, from his previous marriage to Karisma Kapoor, alleged that Priya had forged Sunjay's will. In a new development, Priya and her son argued in the Delhi High Court that the court lacks the authority to restrict their handling of assets located in the UK and the US.

What Priya asserts Delhi HC

In the ongoing dispute over Sunjay Kapur's estate, Priya Kapur's legal representation has asserted that the Delhi High Court's jurisdiction does not extend to foreign assets. A recent update from PTI indicates that the counsel argued the matter of these international properties falls under the purview of foreign legal systems. As a result, they maintain that the Delhi High Court is unable to prevent them from pursuing their claims to Sunjay's immovable properties located abroad.

Justice Jyoti Singh, presiding over the injunction application filed by Karisma Kapoor's children, has requested both parties to submit their written arguments. This application seeks to prevent Priya Kapur from dealing with Sunjay's assets. The court has scheduled the next hearing for December 22 to consider these submissions. The interim application stems from a suit initiated by Karisma Kapoor's children, concerning their late father's alleged will, which reportedly encompasses assets valued at Rs 30,000 crore.

Ongoing legal dispute

In the ongoing legal proceedings, Akhil Sibal, representing Priya Kapur's minor son, clarified that his client has no plans to sell the shares held in Aureus Investments Pvt Ltd (AIPL), which were transferred to her following her husband's passing. However, Sibal emphasized that the Delhi High Court lacks jurisdiction to issue a status quo order concerning immovable assets located in the US and the UK.

Conversely, Senior Advocate Mahesh Jethmalani, acting on behalf of Karisma Kapoor's children, argued that the court has the authority to prevent Priya Kapur from leveraging the allegedly forged will to claim ownership of the properties situated abroad.

Priya Kapur is embroiled in a high-profile legal dispute concerning the estate of her late husband. The case has been brought forth by Karisma Kapoor's children, Samaira and Kiaan, with their mother serving as their legal guardian. Adding to the complexity of the case, Sunjay's mother and sister have also voiced concerns regarding the authenticity of the will.
