Saif and Kareena’s alleged interference became a problem, claims Agent Vinod co-star

The Bombay High Court has refused to grant urgent relief to Vashu Bhagnani’s Puja Entertainment in its legal dispute concerning the film Hai Jawani Toh Ishq Hona Hai and two songs featured in it, Chunnari Chunnari and Ishq Sona Hai. With no immediate order passed against the film, the Varun Dhawan starrer released as scheduled on Friday.

The matter came up before Justice Farhan P. Dubash during the court vacation. Puja Entertainment had approached the court seeking interim relief against Tips Industries Limited, Ramesh Taurani, Kumar S Taurani and filmmaker David Dhawan. The company raised objections related to the use of the film title and the two songs.

During the hearing, the court noted that the plaintiff had already initiated similar proceedings before a civil court in Katihar, Bihar, in April this year. In that case, Puja Entertainment had secured an ex parte status quo order on May 6. However, the order was later challenged before higher courts.

The High Court also took note of the fact that the Supreme Court had stayed the Bihar court’s ex parte order on May 22 while related proceedings remained pending before the Patna High Court.

While seeking relief in Mumbai, the plaintiff informed the court that it had moved an application to withdraw the Bihar suit and intended to pursue the matter before the Bombay High Court. However, no formal order permitting withdrawal had been obtained at the time of the hearing.

Appearing for the defendants, senior advocate Ravi Kadam argued that the plaintiff had engaged in forum shopping and approached the Bombay High Court after considerable delay. He further submitted that the film’s release preparations were already at an advanced stage.

According to the defendants, around 1,900 cinemas and nearly 3,000 screens across India had been booked for the release. They also informed the court that overseas screenings were planned across more than 70 countries.

The court has now listed the matter before the regular bench on June 8. The respondents have been allowed to file their detailed replies before the next hearing.
