Celina Jaitly's plea gets dismissed by Delhi HC after her brother's refusal of legal aid and contact

The court dismissed the petition after finding out that Vikrant did not wish to communicate with his sister and preferred to manage legal issues with his wife, Charul Jaitly.

The Delhi High Court rejected Celina Jaitly's petition for assistance in contacting her brother, Vikrant Jaitly, who is detained in the UAE. The court dismissed the petition after finding out that Vikrant did not wish to communicate with his sister and preferred to manage legal issues with his wife, Charul Jaitly.

Justice Purushaindra Kumar Kaurav, during the March 16 hearing, noted that Vikrant had received consular access but declined legal aid. The court was informed that Vikrant also rejected a free legal representation offer.

Celina had asked for help with her brother's legal costs and sought direct communication, but Vikrant refused both. The court stated that Vikrant did not want to be represented by any law firms, including the pro bono offer. The court directed authorities to maintain contact and offer any legal assistance possible.

Vikrant's wife requested that the case details remain private. The court acknowledged that authorities were consulting with Vikrant and continuing their efforts. The court concluded, “In view of the facts and developments, there is no reason to keep this petition pending, disposed of.”

Vikrant Jaitly, a retired Indian Army officer and Celina Jaitly's brother, has been detained in the UAE since September 6, 2024. Indian media suggests the detention relates to alleged national security concerns, though specific charges remain undisclosed.

Before his detention, Vikrant resided in the UAE since 2016 and worked with the MATITI Group. Celina has expressed concerns about the lack of legal representation, updates, and direct communication with her brother.

On November 3 of the previous year, the court had instructed the Union Ministry of External Affairs to offer legal aid to Vikrant, facilitate communication between the siblings, and designate a nodal officer for the case.

In September 2024, Celina's brother was detained in the UAE due to alleged national security concerns, sparking claims of unlawful detention and restricted access to communication and medical care. Major Vikrant Jaitley's case remains shrouded in ambiguity, with little information available regarding the charges against him. While the Centre's lawyer confirmed consular access, the lack of clarity surrounding the allegations and investigation has raised concerns about a potentially unfair legal situation. Vikrant, who had resided in the UAE since 2016 and worked with the MATITI Group, has not had the nature of the allegations or the status of the investigation shared with his family or legal team, despite repeated requests.
